Frequently asked questions

How accurate do the start and end dates need to be?

The project start and end dates are estimated dates. It's best practice to overestimate the end date.

Can anyone be designated the responsible corporate signatory?

NDEP requires that the Notice of Intent be signed by one of the following:
- A principal executive officer of the corporation (at least at the vice president level) or an authorized representative responsible for the overall operation of the facility from which the discharge described in the application or reporting form originates
- A general partner of the partnership
- The proprietor of the sole proprietorship

Why is the Tax ID needed?

NDEP uses the Tax ID in the Notice of Intent application to determine whether entities are registered to operate in the state.

Why is the owner's information needed?

The owner’s information must be included in the Notice of Intent application. Except in the case of leased property, an owner is the party that has ultimate control and responsibility over the project. In the case of leased property, this role belongs to the lessor.
